Vita Cruises Terms and Conditions

These Terms and Conditions (“Terms”) form a legally binding agreement between Vita Cruises Inc., an Ontario corporation (“Vita Cruises,” “we,” “us,” or “our”), and each guest (“Guest” or “you”) who books, purchases, boards, or travels on any Vita Cruises vessel.

By booking a cruise, purchasing a ticket, checking in, boarding, or otherwise using our services, you acknowledge that you have read, understood, and agreed to be bound by these Terms.

1. ELIGIBILITY, AGE RESTRICTION & ACCEPTANCE OF TERMS

1.1 Eligibility to Travel
All Guests must be legally eligible to travel within, enter, and remain in Canada for the full duration of the cruise and any related activities.

1.2 Adults-Only Policy (19+)
Vita Cruises operates as a strictly adults-only cruise operator. All Guests must be nineteen (19) years of age or older on or before the date of departure. No minors are permitted on board under any circumstances, including infants, children, or accompanied minors.

1.3 Proof of Age & Identification
Valid government-issued photo identification clearly displaying the Guest’s date of birth must be presented at check-in. Vita Cruises reserves the unrestricted right to deny boarding where satisfactory proof of age or identity is not provided.

1.4 Misrepresentation & Denial of Boarding
Any booking made in violation of the 19+ requirement, including through misrepresentation or omission of age, shall be deemed void. Guests who do not meet the age requirement will be denied boarding without refund, voucher, credit, or compensation.

1.5 Authority & Acceptance of Terms
The individual making a booking represents and warrants that they:

  • Have the legal capacity under Ontario law to enter into this agreement; and

  • Have full authority to bind all Guests included in the booking to these Terms.

Completion of a booking, payment, check-in, or boarding constitutes full acceptance of these Terms by each Guest.

2. BOOKINGS, PAYMENT & PRICING

2.1 Payment
Full payment is required at the time of booking unless otherwise expressly agreed in writing by Vita Cruises.

2.2 Pricing Errors
Vita Cruises reserves the right to correct pricing, typographical, or system errors. Where such errors occur, Vita Cruises may cancel the affected booking and issue a refund or voucher at its discretion.

2.3 Non-Transferability
Tickets are non-transferable and valid only for the named Guest(s), sailing date, and vessel specified.

3. CANCELLATION BY GUEST

3.1 Cancellation Method

  • Direct Bookings: Guests must call 1-888-661-6786 ext. 1011 to request cancellation. 
  • Travel Advisor Bookings: Cancellations must be processed through the original travel advisor or agency. 

3.2 Cancellation Fees

  • More than 30 days prior to departure:
    – Eligible for a 100% voucher for the amount paid. 
  • 30 days or less prior to departure (including day of sailing):
    – Subject to a 50% cancellation fee, with the balance issued as a voucher. 

3.3 Refund Form

  • All cancellations are refunded via voucher only, unless otherwise required by the Ontario Consumer Protection Act, 2002. 
  • Vouchers: 
    • Have no cash value 
    • Are non-refundable 
    • Are non-transferable unless approved in writing 
    • Must be redeemed within the stated validity period 

3.4 Processing Time

Vouchers are typically issued within 10 business days, subject to volume and operational constraints.

4. NO-SHOWS & LATE ARRIVALS

Guests who fail to check in or board by the stated time for any reason are deemed no-shows and forfeit the entire fare. No refund or voucher will be issued.

5. CANCELLATION, DELAY OR MODIFICATION BY VITA CRUISES

Vita Cruises may, at its sole discretion, cancel, delay, shorten, reschedule, reroute, or modify any sailing, itinerary, vessel, port of call, schedule, or service for any reason, including but not limited to safety, weather, mechanical, regulatory, or operational considerations.

Vita Cruises shall not be responsible for any incidental or consequential costs incurred by Guests, including transportation, accommodation, meals, or loss of enjoyment.

6. TRAVEL DOCUMENTS & LEGAL COMPLIANCE

Guests are solely responsible for ensuring they possess all required documentation, including valid government-issued identification. Vita Cruises assumes no liability for denied boarding or removal due to inadequate documentation.

7. HEALTH, SAFETY & MEDICAL DISCLAIMER

7.1 Fitness to Travel
Guests warrant that they are medically, physically, and mentally fit to travel.

7.2 Medical Services
Vita Cruises does not guarantee onboard medical services and does not provide medical insurance.

7.3 Removal for Safety
Vita Cruises may deny boarding or remove any Guest whose condition or conduct poses a safety risk, without refund.

8. GUEST CONDUCT & ALCOHOL SERVICE

Guests must comply with:

  • All onboard rules and crew instructions

  • Applicable federal and Ontario laws, including alcohol service regulations

Vita Cruises reserves the right to refuse service, deny boarding, or remove any Guest for intoxication, disorderly conduct, illegal activity, or safety concerns, without refund or compensation.

9. ASSUMPTION OF RISK

Cruise travel involves inherent risks, including vessel movement, weather conditions, and maritime operations. Guests voluntarily assume all such risks by choosing to travel with Vita Cruises.

10. LIMITATION OF LIABILITY

To the maximum extent permitted by Ontario and Canadian law:
Vita Cruises shall not be liable for personal injury, illness, death, property loss, delay, cancellation, or loss of enjoyment.

Any liability shall be limited to the amount paid for the affected ticket.

11. FORCE MAJEURE

Vita Cruises shall not be liable for failure or delay in performance due to events beyond its reasonable control, including acts of God, weather, government action, pandemics, labor disputes, or mechanical failure.

12. PRIVACY

Personal information is collected, used, and disclosed in accordance with Vita Cruises’ Privacy Policy and the Personal Information Protection and Electronic Documents Act (PIPEDA).

13. GOVERNING LAW & JURISDICTION

These Terms shall be governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any dispute shall be exclusively brought before the courts of Ontario.

14. SEVERABILITY

If any provision of these Terms is found unenforceable, the remaining provisions shall continue in full force and effect.

15. ENTIRE AGREEMENT & AMENDMENTS

These Terms constitute the entire agreement between the parties and may be amended by Vita Cruises at any time. The version in effect at the time of booking shall govern.
